In over 20 years of association with the drivers hours regulations the Enforcement Agencies have not undertaken prosecution for the following; 

1.      Only putting the initial and not the Christian name.

2.      Putting abbreviations for locations.

3.      Not putting two dates on the chart, except where the chart goes overnight.

 Under normal circumstances we would only indicate a fault if the spaces on the chart were empty or details misspelled, or part entered.   However it now seems that enforcement officers in certain areas may be instigating prosecutions for these omissions and from the date of this information sheet faults will be shown if any of the above omissions occur. 

 It must be emphasised that it is not at present the common practice, with the enforcement agencies, to prosecute such omissions.  However if only one area does so, we are obliged to point out these faults, to ensure that no driver is prosecuted for these mistakes.

 It has also been stated to a driver, by a Ministry Enforcement Officer, that it is an offence not to put the Surname first and the Christian name second, on the chart.  This is incorrect.  The legislation states;

Each crew member shall enter the following information on his record sheet:

On beginning to use the sheet – his surname and first name.  

It does not say Surname first and Christian name second, just that he is required to enter these details.  

*If any of the above details have been missed off charts they can be added or corrected and the offence will disappear.  It is no offence to correct mistakes on charts. *
