On the 1st of January 2000 the set speed for vehicles, having a maximum gross weight in excess of 12,000 kilos, first registered after 01/01/88 changed from 90km/hr to 85 km/hr.

Vehicles having a maximum gross weight exceeding 7,500 kilos but not exceeding 12,000 kilos first registered after 01/08/1992 still remain limited to 60mph 96.5 KMS/HR.

Changes

‘subject to paragraph 11A a speed limiter fitted to a paragraph (2) vehicle must be set at a speed not exceeding 85km/hr —approx 52.8mph and the stabilised speed of the vehicle must not exceed 90km/hr.’

With the speed limiter set at that particular speed, the vehicle would have a stabilised speed of not more than 90km/hr approx 55.9mph—the speed limiter of the vehicle shall be deemed to be set at a speed of 85km/hr

I have been engaged in discussions with VDO Kienzle, regarding the implications of this change and they have finally given an answer, having discussed the matter with the legal department of The Ministry of Transport, Bristol. The result of these discussions is that as long as vehicles are limited to 90k/hr there will be no action taken by Ministry enforcement officers (taking into account of over-runs).

However if a speed limiter is found to have a stabilised speed higher than 90k/hr action will be taken which may result in the vehicle being prohibited, which could mean a full test before the vehicle can be used again. There have been instances, where the Ministry have plugged the pulse meter into tachograph heads and found that the limiter was set higher than 90km/hr and under these circumstances the vehicles have been prohibited.

It is now your responsibility to bring this information to the attention of your drivers, who should inform you if a vehicle is travelling in excess of 90km/hr (not on over-run). If you don’t the Ministry are quite strict regarding this matter and you will risk having your vehicle prohibited. REMEMBER THE SET SPEED IS 85KM/HR NOT 90KM/HR
