Using the crossed hammers mode

Tachograph mode - crossed hammersFrom the 1st of May 2006, with the introduction of  Regulation (EC) No 561/2006 of the European Parliament and of the Council of 15 March, crossed hammers must now be used to record periods of work.  The box can only be used to record periods of availability. Breaks in relation to WTD

There is a great deal of discussion regarding the interpretation of breaks after 6 and 9 hours under the WTD.  Read about it here

Incorrect use of mode - WTD

The deliberate use of the wrong mode to show break or passive work instead of 'working' could be construed as a false record. Read about it here

The 10 hour night working limit

If your company does not have a Collective or Workforce Agreement opting out of the 10 maximum night working you will be restricted to a working time maximum of 10 hours in a 24 hour period, where a driver starts or finishes a shift between 12.00 midnight and 04.00am.

 

This does not mean that drivers can work for 10 hours during a shift.  It is within a 24 hour period which may include parts of 2 shifts.

 Scottish Smoking in the cab ban

-

On March 26th 2006, Truck drivers visiting Scotland will have to stub out their cigarettes before Gretna and display an A5-sized "no smoking" logo in the cab while on Scottish roads.

Van drivers are also banned from smoking in their vehicles even if they are on their own, as are cabbies, but company car drivers are exempt if they are sole users of the vehicle.

Roadside checks and checks at the premises of undertakings

DIRECTIVE 2006/22/EC OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 15 March 2006 on minimum conditions for the implementation of Council Regulations (EEC) No 3820/85 and (EEC) No 3821/85 concerning social legislation relating to road transport activities and repealing Council Directive 88/599/EEC.

This directive lays down the requirement for authorised inspecting officers to carry out roadside and checks at the premises of hauliers in relation to drivers hours and statutory holidays.
