Update - breaks to be taken after 6 and 9 hours

Following advice from VOSA, Siemens have changed the way that the program determines breaks for 6 and 9 hours driving.  There will be 3 offences.

  1. Failing to take a break of 30 minutes after 6 hours working.

  2. Failing to take a break of 30 minutes between 6 and 9 hours working.

  3. Failing to take a break of 45 minutes where working in excess of 9 hours.

Q.  A client has asked why they can't get an average for the month of April when their period is 07/02 to 07/08. 

They have set their period to run from 07/02 but when they enter dates for just April the RTD report prints out the averages going back to February.

Also there are only 2 RTD reports when the advanced release said there would be 3.

R. The WTD reports will only run for the period specified in the WTD configuration page. This is because none of the WTD calculations have any meaning outside of the legal 4 or 6 month periods. The calculations also have to run between fixed weeks starting on Monday and finishing on a Sunday. The first and last days of a month do not necessarily coincide with the start and end of fixed weeks.

The user can still get monthly averages if they wish when using the WTD Driver analysis report as this will give meaningful figures for each fixed week.

There are 3 reports but the 3rd report is only available on the Gold service, although the 2 most useful reports are included in both Bronze and Silver services.

Correct use of digital tachographs

If you are using clock cards, worksheets or any other method to record working time you may be guilty of making a false record if you do not use the digital tachograph correctly!  Details


Recording All your daily working time.

 

In order for us to perform accurate analysis, where a driver commences, or finishes work before or after recordings on his tachograph chart he should record his start and finish times by drawing a line on the front of the chart indicating his start time EDR - (End of daily rest) and finish time SDR - (Start of daily rest).  He is not required to write the start and finish times on the chart.  

 

EWR and SWR should be used where the weekly rest is ended or started.

 

VOSA guidance.

 

In their booklet Drivers Hours and Tachograph Rules for Goods Vehicles in the UK and Europe, under the heading How are daily rest periods recorded.  The following advice is given.

' When a chart cannot be left in the vehicles tachograph to record a daily rest period, drivers should make manual entries, for example DR 18.30, end DR 06.30.'

Incorrect selection of mode switch

From May 2006 drivers are required by law to use crossed hammers when they are working and the box mode when they are on a period of availability.  These periods are explained in information sheet 23

Where you are using the tachograph to record working time, selecting rest or box mode when you are working so as to keep your average below 48 hours per week will fool no-one. 

Drivers who leave their tachograph on rest or box will be questioned regarding these periods, when stopped by VOSA or the Police and could even risk a silent check.

The only way is to use your tachograph correctly using crossed hammers when you are performing any type of work.

We will not validate analysis where companies or drivers are selecting box when the are working and should be selecting crossed hammers.  This can be construed as a false record.

Settings for the RTD reports

1. You must set your parameters for the RTD reports in respect of your reference period, when it starts and whether or not there is an agreement to opt out of the 10 hour night shift.

2. Once you enter another period you must o to your RTD settings and change the dates of your period to the current ones, otherwise you will not be able to view and print reports for the new period.


What's New

* VOSA is now warning drivers that they will take action for wrong mode selection where a driver leaves the mode on rest all day or does not use crossed hammers for loading and unloading.*  

* You could also risk prosecution for a false record if it can be shown that you deliberately intended to deceive anyone examining the chart into believing that you were on rest or a POA, when in fact you were working! *

Putting the tachograph in after starting or removing it before the end of the shift

Putting your tachograph in after you have started your shift or removing it as soon as you stop driving to reduce the weekly average will not work.  The tachograph should correspond exactly to the start and finish times on clock cards and work sheets.

Some drivers are inserting charts after they have checked the vehicle and the tachograph shows driving immediately, or shows driving as the last duty.  This will be picked up immediately since very few drivers start or finish duty with a driving period.

DO NOT TRY TO BUCK THE SYSTEM.  RECORD ALL OF YOUR DUTY TIME CORRECTLY.  OTHERWISE YOU WILL FACE PROSECUTION FOR FAILING TO KEEP RECORDS OR USING THE WRONG MODE, WHICH COULD RESULT IN A FALSE RECORD IF IT CAN BE SHOWN THAT YOU DELIBERATELY USED THE WRONG MODE WITH INTENT TO DECEIVE.

Incorrect results WTD reports - holidays

When running RTD reports incorrect totals have been reported for weeks where holidays have been recorded, including the Saturday and Sunday, either at the end of the week or between weeks.

For example where a driver takes a holiday from Monday the 1st to Sunday the 7th, if you select holidays in the Driver Planner from the 1st to the 7th, then both Saturday and Sunday will also be recorded as holiday, even though they still show up as non-working days on the driver planner.

When recording holidays only select Monday to Friday as holiday.  If the driver is taking 2 weeks holiday record it in two sessions of Monday-Friday for week one and then repeat for week two.

If you have recorded two weeks holiday for existing drivers and you are experiencing incorrect results then simply go into the driver planner and change the Saturday/Sunday at the end of the holiday week or in between holiday weeks and select non-working day from the drop-down menu at the top, for the days in question.  Save this selection and this will correct the error.

Breaks in relation to WTD

There is a great deal of discussion regarding the interpretation of article 5 of DIRECTIVE 2002/15/EC OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 11 March 2002 regarding the breaks to be taken after 6 and 9 hours working time, especially after the article relating to Stephen Kirkbridge's allegation that certain software is interpreting this part of the legislation incorrectly.

To clarify this I have sent an email to Siemens and they have given their response.

Overspeeds and Speed limiter malfunctions.

There are two offences in relation to overspeeds.

  • The first relates to an overspeed where the limiter is working correctly and which is generally due to the driver exceeding the speed limit for the vehicle, when travelling downhill on overrun.  This is the offence of  Overspeed 90 kph ( 56 mph ), which does not mean that the speed limiter is not working correctly.  

  • Where a vehicle is constantly travelling at speeds in excess of 90 kph then the offence of - Speed limiter may not be working will be indicated.  This can obviously be due to interference by the driver or a mechanical defect.

General Changes

Paper Reports

Paper reports have now been phased out.  There is no need for you to wait for reports through the post.  You can view and print any reports you want online.  Your charts will be returned as normal.

Excess drives, insufficient breaks

Although we endeavour to be as accurate as possible with the analysis you may occasionally see breaks that are just short or drives which are just over the maximum such as, 43 minute breaks, 4.31 or 4.32 cumulative driving , 10.03 daily driving and 8.58, or 8.59 daily rest, etc.

You can either ignore these minor infringements which are normally edited out or you can contact us by email at tachochart@aol.com and we will amend the charts concerned.

It is the responsibility of every client to keep us informed of changes to their fleets and vehicle weights.  We will not be held responsible for incorrect analysis relating to vehicles where we have not been informed of their weights.

Analysing under EEC and Domestic Regulations

Where you have a fleet which involves some vehicles being used under the EEC/RTD rules and others used under Domestic Regulations, you must change the selection before analysing the charts.  

For example if you are analysing charts under EEC/RTD you must go to the Options menu/Hours Law Setup and select EEC/RTD.

If you wish to analyse charts that have been completed under Domestic Regulations you must select UK Domestic.
