Your legal obligation is
to make regular checks
of your tachograph data
to ensure that your
drivers are complying
with the regulations.
This includes checking
all of the data
downloaded from driver
cards and vehicle units
and by this we don't
just mean downloading
the data and printing
off reports we mean that
you need to check each
days data for cards
being left in
overnight/weekend,
journeys without a card,
etc.
Companies start to do
this but staff leave,
other things take
precedence and it
doesn't get done and
before you know where
you are you are being
prosecuted for
permitting your drivers
to commit offences.
Either you need to carry
out these checks or we
need to do it for you.
You will also need to
keep comprehensive
records of the checks
carried out and the
dates, what problems
were found and what was
done about them.
If you do not then you
risk prosecution.

Case study 1 - A
multi-depot company was using one of
the largest analysis providers in
the country. They were
scanning analogue charts,
downloading driver cards and vehicle
units every week, well within the
time constraints for digital data
downloading.
They were
prosecuted by VOSA and successfully
convicted of permitting breaches of
the driver's hours legislation -
why? Because they did not have
the correct analysis and working
procedures in place to demonstrate
compliance with the legislation.
They were not checking their digital
data and were unaware that drivers
were making journeys without cards. They
now have their analysis and and
digital management undertake by us.

Compliance Risk Score (OCRS
Hauliers must prepare for a
new Operators Compliance
Risk Score (OCRS), being
introduced on the 30th of April 2012, as VOSA
prepares to roll out a
revamped version of the
system it has been using
since 2006.
A
prosecution for breaches of the driver's
hours regulations will put you straight into
the Red Band , which will result in you
being targeted by VOSA.

Fact
A transport undertaking
shall be liable for infringements
committed by drivers of the undertaking,
even if the infringement was committed
on the territory of another Member State
or a third country.
The transport undertaking
shall properly instruct the driver and
shall make regular checks to ensure that
drivers are complying with the
regulations.
Fact
Since 2006 VOSA are
required by law to carry out roadside
checks and checks at premises for
breaches of the Drivers Hours
Regulations.
Fact
Drivers must record all
of the time during which they are at
their workstation, at the disposal of
the employer and exercising his
functions or activities. Employers must
record Holidays, Sickness, Working days
to ensure that the mobile worker is not
exceeding an average of 48 hours per
week.
Are you
still using an archaic paper system to
record this information? Why waste
time on a system, which at best is only
going to be an indication of what hours
your drivers are working, when you can
get an accurate detailed report at the
click of a button, if your drivers use
their driver cards as they should.
Fact
Driver's
cards and vehicles must be downloaded
within specified periods, including
agency drivers and hire vehicles. Even if
you download driver's cards and vehicle
units regularly, if you are outside the
specified periods, you will commit an
offence.
